Nondiscrimination Policy
Last updated: July 6, 2021
WeBookCare expects Health Care Workers to provide quality care. Quality care is best achieved when you, the Care Seeker along with the Care Recipient, family, and friends, become partners in care with us.
Health Care Workers are required to comply with all applicable federal, state, and local laws that apply to their scope of practice. Some jurisdictions may have additional legal requirements that expand or limit the civil rights protections of the user community such as legal requirements. Users should contact WeBookCare Customer Support if they have any questions about their obligations to comply with this WeBookCare Nondiscrimination Policy. Guided by these principles, our community will follow these rules when considering potential Care Seekers and Care Recipients:
What Care Recipients expect
To be treated with dignity and respect, without discrimination of any kind; to receive care that is courteous and considerate.
To receive timely and competent care from qualified Healthcare Workers they’ve hired.
To have your Healthcare Workers maintain your privacy and the confidentiality of your medical information.
To have someone you know support you whenever possible.
To have the right to file a complaint and receive a timely response.
What we expect from Care Recipients
To treat Healthcare Workers with dignity and respect, without discrimination of any kind; and to be courteous and considerate of your provider and others.
To inform the Healthcare Worker of anything that could affect your present condition.
To work with the Healthcare Worker to develop and decide on a plan of care that meets your needs.
To follow your plan of care to the best of your ability, and to accept responsibility for the decisions you make about your care.
To act in a safe and responsible manner.
To respect WeBookCare’s policies, rules and regulations.
Race, Color, Ethnicity, National Origin, Religion, Sexual Orientation, Gender Identity, or Marital Status
WeBookCare Healthcare Workers may not:
Decline a booking based on race, color, ethnicity, national origin, religion, sexual orientation, gender identity, or marital status.
Impose any different terms or conditions based on race, color, ethnicity, national origin, religion, sexual orientation, gender identity, or marital status.
Post a profile or make any statement that discourages or indicates a preference for or against any Care Recipient on account of race, color, ethnicity, national origin, religion, sexual orientation, gender identity, or marital status.
Gender Identity
WeBookCare assigns a gender identity to our Users. Care Recipients may prefer either a male or female Health Care Worker.
WeBookCare Health Care Workers may not:
Impose any different terms or conditions based on gender unless the Health Care Workers shares living spaces with the Care Recipient.
Post a profile or make any statement that discourages or indicates a preference for or against any Care Seeker on account of gender, unless the Healthcare Worker shares living spaces with the Care Recipient.
Age and Familial Status
WeBookCare Health Care Workers may not:
Impose any different terms or conditions or decline a booking based on the Care Recipient’s age or familial status, where prohibited by law.
WeBookCare Health Care Workers may:
Provide an age preference that could make the care services unsuitable for Care Recipients of a certain age or for Care Recipients who are children or infants.
Disability
WeBookCare Health Care Workers may not:
Decline a Care Recipient based on any actual or perceived disability.
Impose any different terms or conditions based on the fact that the Care Recipient has a disability.
Substitute their own judgment about whether a care location meets the needs of a Care Recipient with a disability for that of the prospective care services.
Inquire about the existence or severity of a Care Recipient’s disability, or the means used to accommodate any disability, unless it is to assess the suitability of care services. If, however, a potential Care Seeker or Care Recipient raises his or her disability, a Health Care Worker may, and should, discuss with the potential Care Recipient whether the care services meet the potential Care Recipients’ care needs.
Prohibit or limit the use of mobility devices.
Post a profile or make any statement that discourages or indicates a preference for or against any Care Recipient on account of the fact that the Care Recipient has a disability.
Refuse to communicate with Care Seekers or Care Recipients through accessible means that are available, including relay operators (for people with hearing impairments) and e-mail (for people with vision impairments using screen readers).
WeBookCare Health Care Workers may:
Provide factually accurate information about their care services (or lack of them), allowing Care Recipients with disabilities to assess for themselves whether care services are appropriate to their individual needs.
Personal Preferences
WeBookCare Health Care Workers may:
Except as noted above, WeBookCare Health Care Workers may decline a job based on factors that are not prohibited by law. For example, except where prohibited by law, WeBookCare Health Care Workers may decline a job that does not suit their job preferences.
When Care Seekers are turned down. Health Care Workers should keep in mind that no one likes to be turned down. While a Health Care Worker may have, and articulate, lawful and legitimate reasons for turning down a potential Care Seeker, it may cause that User of our care community to feel uncared for or excluded. Health Care Workers should make every effort to be helpful to Care Seekers of all backgrounds. Health Care Workers who demonstrate a pattern of rejecting Care Seekers from a protected class (even while articulating legitimate reasons) undermine the strength of our care community by making potential Care Seekers feel unwanted, and WeBookCare may suspend Health Care Workers who have demonstrated such a pattern from the WeBookCare platform.
What happens when a Health Care Worker does not comply with our policies in this area?
If a particular profile contains language contrary to this nondiscrimination policy, the Health Care Worker will be asked to remove the language and affirm his or her understanding and intent to comply with this policy and its underlying principles. WeBookCare may also, in its discretion, take steps up to and including suspending the Health Care Worker from the WeBookCare platform.
If the Health Care Worker improperly rejects Care Seekers on the basis of a protected class, or uses language demonstrating that his or her actions were motivated by factors prohibited by this policy, WeBookCare will take steps to enforce this policy, up to and including suspending the Health Care Worker from the platform.
As the WeBookCare community grows, we will continue to ensure that WeBookCare’s policies and practices align with our most important goal: To ensure that Care Seekers and Health Care Workers feel cared for and respected in all of their interactions using the WeBookCare platform. The public, our community, and we ourselves expect no less than this.
Additional Considerations
The Nondiscrimination Policy applies to all parts of the WeBookCare business. We recognize there may be additional considerations that need to be made for varied offerings in the WeBookCare Community.
